The terms for the New Heroes membership, community, app and coaching.

The short version

  • New Heroes is a membership for men 18 and over: a library of protocols, a community, and an app that turns a protocol into a 66-day quest of daily moves.
  • It is general information, not medical advice. You use it at your own risk. Talk to a doctor before you change anything about your health, medicine or training.
  • The membership is $49 a month or $397 a year, bought on this website. Cancel any time.
  • Play fair: your account is yours alone, and our content is ours.

1. Who you are agreeing with

These terms are an agreement between you and New Heroes ("New Heroes", "we", "us"), an independent business you can reach at elon@elonmuscular.com. They cover this website and its membership, the New Heroes community, the New Heroes app and one-to-one coaching (together, "the service"). Our Privacy Policy explains how we handle your data and is part of these terms.

You accept these terms when you join or buy on this website, and again when you seal the oath at the end of the app's onboarding.

2. Who can use New Heroes

You must be 18 or older and able to make a binding agreement. The service is built for adult men pursuing their own self-improvement.

3. Not medical advice

When you finish the app's onboarding you seal an oath. Its last line is the agreement this section expands: by sealing, you agree that New Heroes is general information, not medical advice, and that you use it at your own risk.

  • New Heroes is not a medical device and does not diagnose, treat, cure or prevent any medical condition.
  • Protocols, records, moves, quests, questionnaires and coaching are general information drawn from published research. They are not a prescription, a diagnosis or a treatment plan for you.
  • Where a page mentions a medicine, a dose studied in a trial, or a substance, it is information to discuss with your doctor. We do not sell, prescribe or dose any drug or supplement for you.
  • Talk to a qualified healthcare professional before starting a protocol, especially if you have a health condition, take medicine or have had surgery, and before changing any medicine.
  • Exercise, fasting, cold, heat, sleep changes and supplements carry risks. Stop and get help if something feels wrong. New Heroes is not an emergency service: in an emergency, call your local emergency number.

4. Your account

  • You sign in with the email you joined with and a code or link we email you. Keep that inbox safe; anyone who can read it can sign in as you.
  • One account is for one person. Do not share it, sell it or let others use it.
  • Tell us at elon@elonmuscular.com if you think someone else has used your account.

5. Membership and billing

  • The membership is sold on this website. Payments are taken by our payment processor, Stripe. Nothing is sold inside the app.
  • The price is $49 a month or $397 a year, in US dollars. The membership renews automatically each month or each year until you cancel.
  • Cancel any time from your account on this website (Account, then cancel). You keep access until the end of the period you paid for. Deleting your account in the app also cancels the membership, straight away.
  • We may change the price with at least 30 days' notice by email. The new price applies from your next renewal, and you can cancel before it does.

All payments, including coaching, are final and non-refundable, except where the law requires otherwise.

6. Coaching

  • Coaching is one-to-one time with Elon Muscular, sold by the hour: $180 an hour for one or two hours, $170 an hour for three to five, $160 for six to nine and $150 for ten or more, bought together. You pay in full when you buy.
  • After you buy, we email you to book. You use your hours one at a time, when you want them. Each hour comes with a written summary.
  • Coaching is general information and self-improvement guidance, like the rest of New Heroes. It is not medical, psychological, legal or financial advice, and it does not create a doctor-patient or therapist-client relationship. Section 3 applies to it in full.

7. Using the service fairly

You agree not to:

  • copy, resell, republish or scrape our protocols, records, quests, recordings, questionnaires or other content;
  • reverse-engineer the app or try to get around sign-in, rate limits or membership checks;
  • use the service for anything illegal, or to harm yourself or anyone else;
  • post anything unlawful, abusive or infringing in the community, or break its house rules.

We may suspend or close an account that breaks these terms. If we close your account for a reason other than a serious breach, we stop all future billing.

8. Our content and yours

  • The service, its content, names, logos and design belong to New Heroes or our licensors. Your membership gives you a personal, non-transferable licence to use them for your own self-improvement while you are a member.
  • What you log in the app is yours. You give us only the permission we need to store it and give it back to you, as the Privacy Policy describes. You can export it and delete it at any time.
  • The community runs on Circle, and some sessions link to videos on YouTube. Those are third-party services under their own terms.

9. The service as it is

We work to keep New Heroes accurate and running, but we provide it "as is" and "as available". To the extent the law allows, we make no promise that it will be uninterrupted or error-free, or that any protocol or coaching will produce a particular result for you. Your results depend on you, your body and your circumstances. Nothing in these terms takes away rights you have under consumer law that cannot be excluded.

10. Limits on our liability

To the extent the law allows, we are not liable for how you use the information in the service, or for any indirect or consequential loss (including lost profits or data), and our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude.

11. Ending

You can stop at any time: cancel on this website, or delete your account in the app (Profile, Account, Delete my account). When your account ends, your access ends and your data is deleted as the Privacy Policy describes. Sections 3, 8, 9, 10 and 12 continue after your account ends.

12. Governing law and disputes

These terms are governed by the laws of the State of New York, USA. Disputes go to the state or federal courts in New York County, New York, except that if you are a consumer in the EU or UK you may also bring a claim in the courts where you live, and you keep the protection of your local consumer law.

13. The app stores

If you downloaded the app from Apple's App Store or Google Play:

  • These terms are between you and New Heroes only, not Apple or Google. We, not Apple or Google, are responsible for the app and its content.
  • Your licence to the app is non-transferable and limited to devices you own or control, as the store's usage rules permit.
  • Apple and Google have no obligation to provide maintenance or support for the app.
  • If the app fails to meet a warranty that applies, you may tell Apple and Apple may refund the app's purchase price (the app is free to download, so this is zero); Apple has no other warranty obligation.
  • Apple is not responsible for any claim relating to the app, including product liability, failure to meet legal requirements, consumer protection, privacy or intellectual-property claims. We are responsible for those, as these terms set out.
  • You confirm you are not in a country under a US government embargo and are not on a US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Changes

We may update these terms. If a change matters, we will tell you by email or in the app at least 30 days before it applies. If you keep using the service after that, the new terms apply; if you do not agree, you can cancel.
